Problem ogólnie jest dość ciekawy. Należałoby rozważyć jeszcze kilka innych danych w tej sprawie:
- Jak do całego tego skarżenia ma się poszkodowany?
- Czy osoba trzecia może skarżyć w imieniu kogoś?
- A jeśli poszkodowany nie ma żadnych pretensji?

P.S. Dodatkowo, czytając przepisy prawne, zastanawiam się:
1/ Czy poza przewodnikami tatrzańskimi wolno przewodnikom (beskidzcy, sudeccy) prowadzić wycieczki poza wyznakowanymi szlakami? Wydaje mi się, że nie. A w takim wypadku, co z tzw. "ścieżkami chaszczowniczkami"? W ile cudownych miejsc nie prowadzi żaden szlak.
2/ Jak do przepisów mają się przewodnicy studenccy bez uprawnień państwowych? - wydaje mi się, że mają się gorzej niż przodownicy.
