Prokurator musiałby udowodnić
występowanie elementów definiujących przewodnika i wycieczkę (zorganizowaną, nie tylko komercyjną)
w ustawie o turystyce, rozporządzeniu o bezpieczeństwie + przepisy zwiazane.
Zatem raczej bez szans.
W przeciwnym wypadku przewodnik, jako osoba prywatna, skazany byłby absurdalnie
wyłącznie na samotną turystykę ;-)

Inna sprawa, to np. w wypadku ewentualnego nie udzielenia pomocy
potwierdzone posiadanie stosownych umiejętności
jako ewentualna okolicznosć obciazajaca...
- ale to już zupełne gdybalne gdybanie.

Możemy spokojnie prywatnie uprawiać turystykę, Basiu ;-)
