Sprawa jest dosyć prosta i sprowadza się do tego czy przewodnik był za kasę czy nie.

W ustawie tak zdefiniowano przewodnika:

przewodnik turystyczny - osoba zawodowo oprowadzająca turystów lub odwiedzających po wybranych obszarach, miejscowościach i obiektach oraz udzielającą o nich informacji

i to powoduje że IMHO w przypadku przewodnictwa społecznego ustawa nie znajduje zastosowania.
